Welcome to Florida Translate. These Terms and Conditions govern your use of our website (floridatranslate.com) and services. By placing an order or using our services, you agree to be bound by these terms. Please read them carefully.

1. Services

Florida Translate, LLC provides the following services:

Certified Translations: Professional translation of documents including academic transcripts, diplomas, legal documents, medical records, immigration documents, and business documents. All translations include a certification of translation accuracy.

Notarization Services: Remote Online Notarization (RON) performed via the BlueNotary platform in compliance with Florida law. Notarization services are subject to BlueNotary's platform requirements and identity verification procedures.

Apostille Services: Processing of apostille certifications through the Florida Department of State for notarized documents and Florida government issued documents, intended for use in countries that are party to the Hague Apostille Convention.

Official Document Requests: Assistance in obtaining official records from government agencies, including certified court records, vital records certificates, and other government-issued documents on behalf of clients.

Florida Translate, LLC reserves the right to decline any service at its sole discretion.

2. No Legal Advice

Florida Translate, LLC does not provide legal advice. Our services are limited to document translation, notarization facilitation, and administrative assistance. Clients are responsible for determining the legal sufficiency and appropriateness of translated or notarized documents for their intended use. If you require legal advice, please consult a licensed attorney.

3. Orders and Payment

Orders may be placed through our website or by contacting us directly. All orders require prepayment unless otherwise authorized in writing. We accept payment via credit card, debit card, ACH bank transfer, PayPal, and Zelle. All prices are in U.S. dollars and exclude applicable taxes. Prices are subject to change without notice; however, quoted prices will be honored for orders placed within thirty (30) days of the quote. Current pricing is available on our website.

Orders on Hold: Orders may be placed on hold for reasons including, but not limited to, incomplete or illegible documents, discrepancies in page count or scope of work, or other issues requiring clarification or adjustment. In such cases, we will notify you and, if applicable, issue an adjustment invoice. Processing time begins once the issue is resolved, not from the original order date.

Orders remaining on hold for more than thirty (30) days without client response may be canceled. If no services have been performed, the order amount will be issued as a service credit for future services provided by Florida Translate, LLC. Service credits are non-transferable, must be used within one (1) year from the original order date, and are not redeemable for cash.

Payment Disputes: You remain liable for the full amount of services rendered regardless of any payment dispute filed with your bank or credit card issuer. If you initiate a chargeback or payment dispute for services that were properly delivered, you agree to pay (a) all amounts owed for the services, (b) any fees charged to Florida Translate, LLC by payment processors as a result of the dispute, and (c) reasonable costs incurred in collecting such amounts, including attorney's fees and collection agency fees. Disputed charges for completed services may be referred to collections.

4. Document Requirements

Documents submitted for translation should be legible and complete. We work with a wide range of document types, including handwritten documents. However, if a document is too illegible to translate accurately, we will notify you and may request a typed transcript or clearer copy. Florida Translate, LLC is not responsible for errors resulting from illegible source documents where no clarification was provided by the client.

For documents involving non-Latin characters, clients are strongly encouraged to provide the preferred spelling of proper names (as they appear on passports or visas) at the time of order. In the absence of such instruction, Florida Translate, LLC will apply standard and professionally accepted transliteration conventions. Different transliteration standards may result in variations in spelling, which are considered acceptable and do not constitute translation errors.

5. Delivery

Translations are delivered electronically as PDF files through our secure client portal at app.floridatranslate.com. You will receive an email notification when your documents are ready for download. Electronic delivery is deemed complete upon upload to the client portal and transmission of the notification email.

Physical copies may be requested by selecting a shipping option at the time of order or by contacting us to adjust your order. Physical shipments are sent via UPS, FedEx, or USPS at the client's expense. Apostille documents and notarized originals requiring wet signatures are delivered physically.

If a physical shipment is returned to Florida Translate, LLC due to an incorrect address provided by the client, failure to claim the package, or other client-side delivery issues, the client will be responsible for the cost of reshipment. Reshipment will only be processed after payment of the additional shipping fee.

Risk of Loss: For physical shipments, risk of loss passes to you upon delivery of the package to the shipping carrier. Florida Translate, LLC is not liable for packages lost, damaged, or delayed by third-party carriers, including UPS, FedEx, and USPS. We strongly recommend purchasing shipping insurance for time-sensitive or irreplaceable documents. Florida Translate, LLC can assist in filing claims with carriers for lost or damaged packages but cannot guarantee the outcome of such claims.

6. Turnaround Times

Estimated turnaround times are provided for reference only and are not guaranteed. Current processing estimates are available on our fulfillment times page at floridatranslate.com/fulfillment-times. Florida Translate, LLC is not liable for delays caused by weather, government office closures, holidays, shipping carrier delays, high volume periods, or other circumstances beyond our reasonable control.

7. Translation Accuracy and Corrections

Florida Translate, LLC certifies that translations accurately reflect the content of the source documents provided. We do not certify the authenticity, accuracy, or legal validity of source documents themselves.

If you identify an error in our translation that is attributable to Florida Translate, LLC (not an error, ambiguity, or illegibility in the source document), we will correct it at no additional charge, provided you notify us within six (6) months of delivery. Requests for changes due to modifications in the source document, client preferences in terminology, or stylistic choices may be subject to additional fees.

8. Acceptance Guarantee

Florida Translate, LLC guarantees that its certified translations will meet the formal certification and accuracy requirements typically required by receiving institutions, including USCIS. However, Florida Translate, LLC does not control and cannot guarantee the independent acceptance decisions of third parties. If a translation is rejected solely due to a demonstrable translation or certification error attributable to Florida Translate, LLC, we will correct the translation at no additional charge or issue a refund, at our discretion.

9. Notarization Services

Remote Online Notarization is performed via the BlueNotary platform in accordance with Florida Statutes governing electronic notarization. By using our notarization services, you acknowledge and agree to the following:

  • (a) You will be required to complete identity verification through BlueNotary, which may include knowledge-based authentication and biometric facial recognition;
  • (b) If identity verification fails, the notarization session cannot proceed. You may be required to reschedule, and a rebooking fee may apply;
  • (c) All notarization sessions are recorded via audio and video as required by Florida law. By booking a session, you consent to this recording;
  • (d) BlueNotary is required by Florida law to retain records of notarization sessions, including audio-visual recordings, for a minimum of ten (10) years;
  • (e) Florida Translate, LLC cannot delete notarization records held by BlueNotary, even upon request, due to statutory retention requirements;
  • (f) Florida Translate, LLC facilitates notarization services but the notarial act is performed by a commissioned Florida notary public.

Notarization Pricing: Online notarization services are priced at $25 per notarial act, plus RON platform fees including identity verification and biometric authentication as shown in your receipt. Additional signers are $20 each. Pricing is subject to change; current rates are available on our website.

Missed Appointments: Missed or no-show notarization appointments may be subject to a rebooking fee of up to $25. Florida Translate, LLC reserves the right to require prepayment of the rebooking fee before scheduling a new appointment for clients with a history of missed appointments.

10. Apostille Services

Apostille services involve submission of documents to the Florida Department of State for certification. Not all documents are eligible for apostille. We will advise you if your document does not meet the requirements for apostille certification.

If the Florida Department of State rejects a document for apostille, Florida Translate, LLC will notify you and provide information on alternatives to complete the service, if available. If no alternative is viable or you choose not to proceed, a refund will be issued minus any non-refundable fees already incurred (such as notarization fees or shipping costs).

11. Intellectual Property

Upon full payment, you own the translation of your document(s). Florida Translate, LLC retains all rights to its translation processes, methodologies, templates, formatting styles, certificate designs, branding, logos, and other proprietary materials. Nothing in these Terms prohibits attorneys, law firms, businesses, or other professionals from submitting orders on behalf of their clients or distributing completed translations to the intended end recipient.

12. Confidentiality and Data Retention

Florida Translate, LLC treats all client documents and information as confidential. We will not disclose your documents or personal information to third parties except as necessary to perform our services (e.g., translators, notaries, the Florida Department of State) or as required by law.

Documents submitted for translation are retained for a minimum of twelve (12) months to facilitate corrections, re-orders, and customer service. After this period, documents may be archived or deleted at our discretion.

Florida Translate, LLC may retain copies of translations for quality assurance, training, and internal recordkeeping purposes, provided that any such use does not disclose personally identifiable information beyond what is necessary to perform these functions.

You may request deletion of your documents at any time by contacting us, except where retention is required by law (such as notarization records, which must be retained by BlueNotary for ten years pursuant to Florida statute).

We utilize third-party service providers for payment processing, notarization, cloud storage, and other functions. These providers have their own data handling practices and retention policies, which are outside Florida Translate, LLC's control.

13. Cancellation and Refunds

Translation Services:

  • Full Refund: Available if you cancel before translation work has begun.
  • Partial Refund (50%): Available if you cancel after work has begun but before delivery.
  • Post-Delivery: No refund after delivery, except where the translation is formally rejected by the intended recipient institution solely due to a demonstrable translation error attributable to Florida Translate, LLC (documentation from the rejecting institution required). In such cases, Florida Translate, LLC will, at its option, either provide a corrected translation or issue a refund.

Expedited and Rush Orders:

  • Full Refund: Available if you cancel before work has begun.
  • No Refund: Once work has begun on an expedited or rush order, no refund is available.

Notarization Services:

  • Full Refund: Available if you cancel at least one (1) hour before your scheduled appointment time.
  • No Refund: Once the notarization session has been performed, no refund is available. If identity verification fails and the session cannot proceed, you may reschedule; refunds for failed verification are issued at Florida Translate, LLC's discretion.

Apostille Services:

  • Full Refund: Available if you cancel before any non-refundable fees have been incurred (such as notarization or shipping).
  • Partial Refund: If you cancel after documents have been shipped to us or after notarization has been performed, a refund will be issued minus non-refundable fees already incurred.
  • Post-Submission: Once documents have been submitted to the Florida Department of State, fees paid to the Department are non-refundable. If the Department rejects the filing, Florida Translate, LLC will provide alternatives or issue a refund of our service fee minus non-refundable costs.

Non-Refundable Fees:

  • Shipping costs are non-refundable once a package has been tendered to the carrier.
  • Payment processing fees (credit card transaction fees) retained by third-party processors are non-refundable.
  • Government fees paid on your behalf (e.g., Florida Department of State apostille fees) are non-refundable once submitted.
  • Notarization fees are non-refundable once the notarial act has been performed.

Refunds, when issued, will be processed to the original payment method within ten (10) business days of approval.

Cancellation Procedure and Effective Time:

All cancellation requests must be communicated in writing. Written notice may be provided by email, through the client portal ticket system, via WhatsApp, LiveChat, or other official customer support channels maintained by Florida Translate, LLC.

Cancellation requests are deemed effective upon receipt by Florida Translate, LLC during normal business hours, which are Monday through Friday, 9:00 AM to 5:00 PM Eastern Time, excluding federal holidays. Cancellation notices received outside of business hours will be deemed effective on the next business day unless acknowledged earlier by our team in writing.

Refund eligibility, where applicable, is determined based on the effective time of cancellation in relation to when work on the order commenced or services were performed.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLORIDA TRANSLATE, LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

FLORIDA TRANSLATE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: VISA DENIALS OR DELAYS; REJECTION OF APPLICATIONS BY THIRD PARTIES; MISSED DEADLINES; LOST BUSINESS OPPORTUNITIES; EMOTIONAL DISTRESS; OR ANY OTHER DAMAGES ARISING FROM THE USE OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UPON WHICH YOUR CLAIM IS BASED, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify, defend, and hold harmless Florida Translate, LLC and its officers, directors, members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees and court costs) arising from:

  • (a) Your submission of false, fraudulent, forged, or misleading source documents;
  • (b) Your misuse of translations, notarized documents, or other deliverables;
  • (c) Your violation of these Terms and Conditions;
  • (d) Your infringement of any third party's intellectual property or other rights;
  • (e) Any dispute you initiate with a payment processor for services that were properly delivered.

16. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution: Before initiating arbitration, you agree to contact us at info@floridatranslate.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within thirty (30) days. If we cannot resolve the dispute informally, either party may proceed to arbitration.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or our services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Orange County, Florida, unless you and Florida Translate, LLC agree otherwise. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver: YOU AND FLORIDA TRANSLATE, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THAT PARTY'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court in Orange County, Florida, if the claim qualifies for small claims jurisdiction.

17. Force Majeure

Florida Translate, LLC shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God; natural disasters; pandemic, epidemic, or public health emergency; war, terrorism, or civil unrest; government actions, orders, or office closures; labor disputes; utility or telecommunications failures; cyberattacks; or carrier delays.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, Florida.

For order-specific requests, corrections, or modifications, we recommend submitting a support ticket through the client portal to ensure your request is documented and associated with your order.

20. Changes to Terms

Florida Translate, LLC reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

22. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmations, quotes, or service agreements, constitute the entire agreement between you and Florida Translate, LLC regarding our services and supersede any prior agreements, representations, or communications, whether written or oral.
